DRAFT — NOT ATTORNEY-REVIEWED
# DRAFT — NOT ATTORNEY-REVIEWED Draft date: November 3, 2026 AI Tools — Tap Card Service · Terms of Service (Individuals) Fast Eddie Web LLC, Pittsburgh, Pennsylvania
These terms are between Fast Eddie Web LLC ("Fast Eddie Web," "we") and you, the individual account holder ("you"). They cover Fast Eddie Web's tap-card service (the "Service") — one of Fast Eddie Web's AI Tools products. This is the same company, and the same legal entity, as Fast Eddie Web's website business; the Service is simply a product you can buy with or without a website. If your card was provided under an organization account, the Organization Addendum also applies, and where it conflicts with these terms for organization cards, the Addendum controls.
By creating an account and subscribing, you accept these terms.
1. What the Service is
- The Service gives you a digital business card: a personal card page (your name, photo or logo, title, and the contact actions and links you choose), a QR code and a downloadable contact file (vCard) guests can save, and an optional physical NFC tap card that opens your card page.
- Guests can share their own contact information back to you from your card page ("share-back"). Shared information is delivered to you in your account.
- You edit your own card in your account — photo or logo, contact rows, links, accent color, and light/dark theme. Fast Eddie Web controls the layout and typography so every card stays clean and works the same way for guests.
- Your card page carries a small "get your own card" link below your contact actions. Signups that arrive through it are credited to your card. Any referral reward program will be governed by the program terms posted when that program launches; these terms don't promise a reward.
- In the current version of the Service, Fast Eddie Web does not send text messages to your guests, and the Service has no automatic texting feature. Any automated or AI-assisted feature added later will be clearly labeled as automated.
2. Your account
- You must be at least 18 and able to enter a contract.
- Keep your account information accurate. You sign in by email link — keep control of that email account; anyone who can open your sign-in link can act as you.
- You're responsible for everything done through your account and on your card.
- One person, one individual account. Don't share, sell, or transfer your account.
3. Your card content
- You own your content: your name, photo or logo, business name, and the text and links you put on your card.
- You confirm you have the right to use everything on your card, and you vouch for its accuracy — titles, credentials, license numbers, claims, and links are your statements, and you're responsible for their truth.
- You're responsible for your content, and you agree not to use the Service for any unlawful purpose.
- We don't monitor cards and we have no obligation to — but we may, at our sole discretion and without notice, remove or hide any content, take a card offline, or suspend an account, including for anything unlawful, pornographic, obscene, or otherwise objectionable.
- You give Fast Eddie Web permission to host, display, and transmit your content as needed to run the Service (including showing your card page publicly — that's the point of the card), and to show your card in Service examples and marketing unless you opt out in writing.
- The platform itself — the software, card engine, templates, designs, and know-how behind the Service — belongs to Fast Eddie Web and is never transferred to you. You get the use of it while subscribed, nothing more.
4. Price, billing, and renewal
- Price: $5.00 per month per person, plus tax where applicable. Tax is calculated from your billing address and shown before you pay.
- Recurring billing consent: Before the first charge, the signup flow clearly discloses the monthly amount, any tax, how often you'll be billed, and that the plan renews automatically each month until you cancel. By entering your payment method and completing signup, you give express consent to these recurring charges and authorize Fast Eddie Web (through its payment processor, Stripe) to charge your payment method monthly, plus any one-time charges you approve (for example, a physical card).
- Founding price: If you subscribe at a founding price, that price stays yours for as long as your subscription stays continuously active. If you cancel and return later, the then-current price applies. If Fast Eddie Web ever raises the standard price for other subscribers, it will give at least 60 days' written notice.
- Physical card: A physical NFC tap card is a separate one-time charge of $[ ] — never part of the monthly price — charged only when you order one. The card carries only your card page's address; the card itself is yours to keep. Replacement cards are available at the price posted when you order the replacement.
- Free cards: If your card was provided free inside a Fast Eddie Web website agreement or as a pilot card, it stays free while that arrangement lasts and is governed by those terms while it does.
- Failed payment: If a charge fails, we'll notify you and you have 14 days to fix it. During that window your card stays live. If payment is still unresolved after 14 days, Fast Eddie Web may suspend the Service until it's fixed.
5. Cancelling
- You can cancel anytime. There is no minimum term and no early-cancellation fee for individual subscriptions.
- Cancel in your account settings or by email. Fast Eddie Web will confirm your cancellation by email, and that confirmation is the formal record that you cancelled.
- Cancellation takes effect at the end of the current paid month; your card stays live until then, and no further charges are made after your cancellation is confirmed. Fees already paid are not refunded for a partial month, except where the law requires.
- After your card goes offline, you have 30 days to export your card data and the guest information in your account. After that, it's deleted as described in the Privacy Policy.
6. Guests and their information
- When a guest shares their information through your personal card, that information is shared with you. As between you and Fast Eddie Web, it's yours — Fast Eddie Web processes and stores it only to run the Service, delivers it to you, and never sells it or uses it for Fast Eddie Web's own marketing.
- In exchange, you agree to treat it the way the guest would expect:
- Use it to follow up on the conversation you actually had — nothing else.
- Never sell it, rent it, or hand it to a list broker or advertiser.
- Honor any guest's request to stop contacting them or to delete their information, promptly.
- Comply with the laws that apply to how you contact people (including texting and email laws). The Service does not text your guests; if you contact guests yourself, that's your responsibility.
- Fast Eddie Web records what the guest was shown and what they agreed to when they shared (the disclosure text, their action, and when) and can show you that record in your account.
7. Acceptable use
You may not use the Service to: break the law; impersonate someone or misrepresent who you are or who you work for; put false or misleading claims, credentials, or links on your card; infringe anyone's rights; send spam or harassing messages; or probe, disrupt, or try to access parts of the platform or other customers' accounts that aren't yours.
8. Availability — honest limits
- Fast Eddie Web works to keep the Service live and monitored, but no service can promise 100% uptime, and uptime is not guaranteed.
- The Service depends on third parties Fast Eddie Web doesn't control — hosting and network providers (including Cloudflare), payment processors, phone operating systems, and NFC/QR behavior on guests' phones. Their outages, policy changes, or errors are not Fast Eddie Web's breach.
- If the Service is unavailable for a full calendar day or more due to an error on Fast Eddie Web's side, your remedy is a credit of one month's subscription fee. Fast Eddie Web is not liable for lost sales or profits (see Section 10).
9. Suspension and termination
- Fast Eddie Web may suspend or end your account immediately if your card is used for unlawful purposes, if you materially breach these terms and don't fix the breach within 10 days after Fast Eddie Web gives notice, or if fees remain unpaid after the grace period in Section 4.
- Sections 3 (your content), 6 (guest information), 9, 10, and 11 continue to apply after your account ends.
10. Liability — carried from our website agreement
- Warranties: Fast Eddie Web will perform the Service in a professional, workmanlike manner consistent with industry standards. EXCEPT FOR THAT PROMISE, THE SERVICE IS PROVIDED "AS IS," AND FAST EDDIE WEB DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. If the Service does not meet the professional-workmanlike promise, your sole remedy is for Fast Eddie Web to re-perform the affected work (or, for downtime on Fast Eddie Web's side, the one-month credit in Section 8).
- Liability cap: In all cases, and to the fullest extent allowed by law, FAST EDDIE WEB'S TOTAL LIABILITY UNDER THESE TERMS IS CAPPED AT THE GREATER OF (A) THE FEES YOU PAID IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ALL FEES YOU HAVE PAID UNDER THESE TERMS. This cap, and the exclusion of damages below, do not apply to liability that cannot be limited under Pennsylvania law, such as liability for fraud, willful misconduct, or bodily injury.
- Excluded damages: EXCEPT FOR THE CARVE-OUTS ABOVE, FAST EDDIE WEB IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOST SALES, LOST PROFITS, LOST REVENUE, LOST DATA, OR LOST GOODWILL, EVEN IF THE LOSS WAS FORESEEABLE AND EVEN IF A LIMITED REMEDY IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE.
- Standing behind your content: Because you provide and vouch for your card content, you will defend and reimburse (indemnify) Fast Eddie Web for any third-party claim, loss, or expense (including reasonable attorneys' fees) arising from your content, your claims, or your use of guest information — for example, claims of intellectual-property infringement, false or misleading advertising, or unlawful outreach. Fast Eddie Web will promptly tell you about any such claim and let you control the defense, and you will not settle a claim in a way that imposes obligations on Fast Eddie Web without its consent.
11. The basics
- Entire agreement: These terms, together with the Privacy Policy and (where it applies) the Organization Addendum, are the entire agreement for the Service. Marketing pages and conversations outside these documents don't add promises or change the terms.
- Changes: Fast Eddie Web may update these terms; material changes will be emailed to you at least 30 days before they take effect. If you don't agree, you may cancel before the effective date at no penalty. Continuing to use the Service after the effective date means you accept the updated terms. (Price changes are governed by Section 4, not this section.)
- Severability: If any part of these terms is found unenforceable, the rest still stands.
- Governing law and venue: Pennsylvania law governs these terms (without regard to its conflict-of-laws rules). If there's a disagreement, both sides agree to talk it out in good faith first. If that doesn't resolve it, any lawsuit must be brought in the state or federal courts located in [county], Pennsylvania, which both sides accept as the proper venue. In any dispute about these terms, the prevailing party may recover its reasonable attorneys' fees and costs.
- Confidentiality: Each side will keep the other's non-public information confidential and use it only to carry out these terms, except for information that is or becomes public, is already known, or must be disclosed by law. (Your card page itself is public by design.)
- Events outside our control: Neither side is responsible for delays or failures caused by events beyond its reasonable control (for example, natural disasters, outages at hosting providers or carriers, power or internet failures, or government actions). This does not excuse your obligation to pay amounts owed.
- Assignment: You may not transfer your account or these terms without Fast Eddie Web's written consent. Fast Eddie Web may assign these terms or use qualified subcontractors and service providers to run the Service, and remains responsible for the Service.
- Notices: Day-to-day notices may be sent by email to the address on your account. Formal notices — such as cancellation or notice of a claim — must be sent by email with confirmation of receipt; cancellation follows Section 5.
